How Are Foreigners Who Commit Crimes in China Sentenced? Legal Framework and Types of Penalties

As China becomes increasingly internationalized, more and more foreigners come to China for work, study, and daily life. While the vast majority of foreign nationals abide by Chinese laws, a very small number may violate criminal laws due to unfamiliarity with the legal system or misplaced assumptions.

This article provides an overview of the jurisdictional principles and sentencing rules that apply when foreigners commit crimes involving China.

1. Crimes Committed Within Chinese Territory

Under Article 6 of the Criminal Law of the People's Republic of China (the principle of territorial jurisdiction), the Criminal Law applies to all crimes committed within the territory of the PRC, unless otherwise provided by law. This extends to crimes committed aboard Chinese ships or aircraft.

A crime is deemed to have been committed within Chinese territory if either the act or the result occurs within China.

It should be noted that the criminal liability of foreigners who enjoy diplomatic privileges and immunities is resolved through diplomatic channels rather than through direct application of China's criminal justice procedures.

2. Administrative Offenses by Foreigners in China

Where a foreigner violates public security administration without committing a crime, the Public Security Administration Punishments Law provides for the following penalties:

  • Warning
  • Fine
  • Administrative detention
  • Revocation of permits issued by the public security authorities

Additionally, an order to leave the country within a specified period or deportation may be imposed as a supplementary measure.

3. Crimes Committed by Chinese Citizens Abroad

Under Article 7 of the Criminal Law (the principle of personal jurisdiction), Chinese citizens who commit crimes outside Chinese territory that are punishable under the Criminal Law are subject to Chinese criminal jurisdiction. However, where the maximum punishment prescribed is fixed-term imprisonment of no more than three years, the authorities may choose not to pursue the case.

State functionaries and military personnel who commit crimes outside Chinese territory are subject to the Criminal Law without exception.

4. Crimes Committed by Foreigners Abroad Against China or Chinese Nationals

Under Article 8 of the Criminal Law (the principle of protective jurisdiction), a foreigner who commits a crime outside Chinese territory against the Chinese state or against Chinese citizens may be subject to the Criminal Law if the minimum punishment prescribed is fixed-term imprisonment of three years or more. This does not apply, however, where the act is not punishable under the law of the place where it was committed.

5. Application of Deportation

Article 35 of the Criminal Law provides that deportation may be applied to foreigners who commit crimes, either independently or supplementarily:

  • Independent application: For relatively minor offenses that do not warrant a principal penalty, the court may impose deportation as a standalone penalty.
  • Supplementary application: For more serious offenses, deportation may be imposed in addition to a principal penalty (such as fixed-term imprisonment), with deportation to be executed after the principal penalty has been served.

Conclusion

China is a country governed by the rule of law. All persons within Chinese territory, regardless of nationality or status, must comply with Chinese law. Foreign nationals do not enjoy judicial privileges above the law in China. Any violation of the law not only results in sanctions under the Chinese legal system but may also have long-term adverse effects on residence permits and future entry into China.
